The coalition of food growers and producers identified as signatories to the attached letter (the “Food Coalition”) provide comments on a possible change to the naturally occurring regulation that implements Proposition 65, section 25501(a)(3).

FBIA Letter to USDA Requesting NBFDS Enforcement Discretion
ASTA signed onto an FBIA coalition letter to the United States Department of Agriculture (USDA) in March 2021 requesting that the USDA's Agricultural Marketing Service maintain the compliance date for the National Bioengineered Food Disclosure Standard of January 1, 2022, and exercise enforcement discretion for products that do not yet bear the disclosure on their label or in labeling materials for an additional year until January 1, 2023.
